Frequently asked about Esher

Do I need planning permission for replacement windows in Esher?

Elmbridge's own Esher Conservation Area Character Appraisal answers this directly: "Many of the properties in the conservation area are single family dwellings. They therefore have permitted development rights, which means that minor works, such as the replacement of windows or doors... do not require planning permission." Listed buildings and flats are the exceptions.

Does Elmbridge have an Article 4 direction on windows?

No. Elmbridge has exactly two Article 4 directions, both on land at Cobham - Pointers Road (made September 2019, confirmed March 2020) and Woodlands Lane (made March 2024, confirmed as modified September 2024). Both cover gates, fences and walls and the temporary use of land. Neither touches householder windows.

What is the Esher conservation area called officially?

Just "Esher". It was designated on 31 July 1973 by Surrey County Council and extended on 27 February 2008. There is no Esher High Street or Esher Common conservation area. Claygate has two separate designations: Claygate Village (1990) and Claygate Foley Estate (1994).

What does Elmbridge ask for on window design?

Its conservation area guide asks that "the style of doors and the type and proportion of new windows should reflect those on the main property. Windows should be recessed by the same amount and positioned to conform with existing spacing." The Esher appraisal lists sash windows replaced with PVCu units among insensitive alterations - a criticism, not a prohibition.

Which design guidance applies to my application?

The Elmbridge Design Code SPD, adopted 17 April 2024, replaced the earlier Design and Character SPD for all planning applications submitted after 6 January 2025. Its materials section advises traditional materials and detailing in sensitive historic settings such as conservation areas.

Elmbridge is the least restrictive borough we cover

Esher is in Elmbridge Borough Council, Surrey, which has 26 conservation areas covering more than 2,000 properties. What it does not have is any Article 4 direction affecting householder windows or doors - its only two directions cover land at Cobham and concern fences, gates and temporary use of land.

That means the default position for a single family dwelling in Esher, even inside the conservation area, is permitted development. Elmbridge says so itself in the Esher appraisal. Several of its appraisals recommend considering Article 4 directions, but describe it as case by case and resources permitting.

The adopted policy is Policy DM12, Heritage, in the Elmbridge Local Plan Development Management Plan of April 2015, which asks that development within or affecting a conservation area preserve or enhance character and appearance, taking account of streetscape, plot and frontage sizes, materials and the relationship between buildings and spaces.

Many Esher estates are governed by private covenants rather than planning designations. Those are a contractual matter between you and the estate, and the council has no role in enforcing them.
